We rejoice in the decision of the assembly not to pass the Civil Code in its current state because it does not guarantee equality in the right to marriage. Also, the alternative offered in the form of civil partnership creates uncertainty and does not offer solutions to guarantee the right to family life of LGBTIQ + communities.
However, the Civil Code gave rise to today’s debate in parliament that highlighted discriminatory, homophobic views and rhetoric and incitement to hatred. Disappointed with the level of discussion of opponents of same-sex marriage, we call on political parties to take measures that increase tolerance and remind MPs of their constitutional obligations to ensure equality before the law for all.
We thank the MPs who came out in support of marriage and advocated for equality.
We call on the Government of Kosovo to avoid the shortcomings of the current code in the next version of the Civil Code and to enable marriage for all.
